Mr. President Editors U.S. Citizens Legislators Governors Mr. Attorney General Dear Sirs and Mesdames; A.D. 2008-2009 KIDNAPPED FOR STATE PROFIT The Judges of the Third Appellate and Supreme Courts of Texas are much to be praised for ruling by law and not by political correctness in the CHASTISING OF DISTRICT COURT JUDGE BARBARA WALTHER AND HER GESTAPO - CHILD PROTECTIVE SERVICES - FOR THE ABUSE OF POWER ENTRUSTED TO THEM IN THE ILLEGAL KIDNAPPING AND FALSE IMPRISONMENT OF OVER 400 PLUS CHILDREN FROM THE FLDS RELIGIOUS COMPOUND IN EL DORADO, TEXAS. The whole world stood appalled at the depths to which our once great nation had descended whenConstitutional protections of citizens' rights were completely ignored and sweet innocent children were rippedaway from the security of their fathers and homes, herded with their mothers into detention camps, and thentorn away from their mothers and scattered across the state of Texas in its camps for juvenile incorrigibles.Even after the Appellate Court ruled the seizure illegal, Judge Walther continued to force the children tolanguish in severe separation anxiety: away from their families; in an environment totally alien to them; in closeproximity to children whose behavior was so obnoxious and dangerous that Texas foster families refused tohave them in their homes! THE ABUSE OF THOSE CHILDREN AND THEIR FAMILIES UNDER THE MANTRA OF "CHILD ABUSE PROTECTION" BOGGLES THE MINDS OF FREEDOM LOVING AMERICANS! Having observed, and been personally victimized by similar injustice in child custody rulings inMaryland, and as President of the Maryland Fathers Rights League, and President and Founder of theCumberland Historic Cemetery Organization which, for the past 25 years, has not only erected and restoredover 800 monuments, but has also actively promoted the Constitutionally protected freedoms embraced by ourFounding Fathers, I was perplexed that such injustices could even be happening in a country where citizensshould be enjoying those Constitutional protections of their liberties.I would like to share what the research teams of these two organizations discovered to be THEANSWER TO WHY STATES ARE SO ANXIOUS TO RIP CHILDREN AWAY FROM THEIR NATURAL PARENTS. IT IS THE HIDDEN AGENDA THAT HAS SWAYED ALMOST EVERY CUSTODY CASE IN AMERICA FOR THE LAST 15 YEARS (much to the detriment of the mental health of the rising generation)and it was NEVER MENTIONED IN ANY OF THE PUBLIC DEBATE that the kidnapping of the FLDSchildren precipitated! The answer is that THE FEDERAL GOVERNMENT PAYS STATES $4.2 BILLION DOLLARS ANNUALLY TO SEPARATE CHILDREN FROM THEIR NATURAL PARENTS, especially their fathers. Yes, you read that right! The State of Texas, and in particular their Family Court, along with the hijacked Criminal Justice System and Child Protective Services, was making a vicious play for a huge share of the $4.2billion annual Federal dollars earmarked for states who set themselves up as the collectors of child support from parents (usually fathers) who have lost physical custody of their children. The unintended consequence of laws passed in the 1990's designed to encourage true deadbeat dads to support their children has morphed into the opportunity for states to legally manipulate all divorced fathers, who come through the Family Court System, into the "deadbeat dad" requirements, so they can access the windfall of Federal funds available when the State collects child support from them. Here's how they do it. First, they DECLARE THE FATHER TO BE NON-CUSTODIAL when they award full physical custody to the mother. THE MORE TIME THE FATHER IS REMOVED FROM THE CHILD'S LIFE, THE HIGHER THE CHILD SUPPORT CAN BE SET (AND THE MORE MONEY THE STATE CAN GET); fathers are often allowed only several hours, or a few days of visitation a month. THE CHILD SUPPORT, ORDERED BY THE COURT, IS OUTRAGEOUSLY HIGH, AND QUICKLY DRIVES FATHERS INTO BANKRUPTCY and the inability to pay what is ordered. AS THEY SLIP INTO ARREARS IN THEIR PAYMENTS THEY MEET THE LEGAL REQUIREMENT OF "DEADBEAT DAD," SO THE STATE CAN ACCESS THE FEDERAL MONEY. Fathers are brutally hounded by the hijacked Criminal Justice System with garnishment of their wages, seizure of other assets like their tax refunds, and even the very tools with which they need to make their livings, and to visit their children (on the rare occasion allowed) - their driver's licenses and passports are seized as well! ALL THIS IS DONE IN VIOLATION OF THEIR CONSTITUTIONAL RIGHT TO DUE PROCESS WITHOUT EVER HAVING BEEN CONVICTED OF A CRIME IN A COURT OF LAW, BUT IT PUTS THE WINDFALL OF FEDERAL MONEY INTO STATE COFFERS BECAUSE THE STATE HAS "MANUFACTURED" ANOTHER "DEADBEAT DAD." Often the money garnered from the Federal Government by the states far exceeds the dollar for dollar amount actually collected in child support. It has been documented that in some cases it has actually been $10 to $30 Federal dollars per dollar collected. With these figures, do the math: For every $1000 per month of child support collected by the state, they could receive $10,000 to $30,000 per month from the $4.2 billion Federal dollars earmarked annually for child support collection. Now, multiply those monthly figures times 400 plus children seized from the FLDS compound, and it's easy to see why greed trumps justice in child custody cases, and why the state did not want to return those children to their natural parents: they needed to hold custody of the children in order to get the money! CHILD PROTECTIVE SERVICES IS FUNDED BY THE FEDERAL WINDFALL OF MONEY that the state receives for collection of child support, so naturally they were actively involved in this judicial kidnapping; BUT IT IS NOT THE CHILDREN THEY WERE PROTECTING, IT'S THE MONEY THAT FUNDS THEIR JOBS! THE COURT APPOINTED CHILDREN'S ATTORNEYS are also paid out of this money. THEY ACT AS "YES-MEN" AND "YES-WOMEN" DURING CUSTODY HEARINGS TO AFFIRM THAT FATHERS SHOULD BE STRIPPED OF PHYSICAL CUSTODY OF THEIR CHILDREN, WHICH GUARANTEES THAT THE FEDERAL MONEY WILL FLOW INTO STATE COFFERS AND FILL THEIR POCKETS! JUDGES AND THEIR COURTS FILL THEIR COFFERS WITH THIS MONEY, TOO, both directly, by padding court budgets, and indirectly, by further fleecing of the non-custodial parents: with court-ordered counseling sessions, parenting, classes, job training programs, and psychological evaluations for which outrageous prices are charged, and the court profiteers who provide these "services" then donate to the judge's reelection campaigns. Also, if a non-custodial parent only receives "supervised visitation" privileges, HE MUST PAYTO SEE HIS CHILDREN! Prices vary for this "service." In Maryland we have documented evidence of $40 per visit to $1000! The $1000 was what a father was told he must pay at a visitation center run by Catholic Charities in Allentown, PA where his child and the child's mother currently reside. Yes, the cancer of greed has even invaded the faith-based organizations; THE KIDNAPPING OF CHILDREN IS SO PROFITABLE! THE KIDNAPPING OF THE 400 PLUS FLDS CHILDREN WOULD HAVE BEEN THE MOST PROFITABLE EVER ON RECORD; not just because it involved so many children, but because it was the state's intention, from the very beginning, TO KIDNAP THOSE CHILDREN FROM BOTH THEIR PARENTS in order to plunder the wealth of their entire community by means of child support collection. NOT ONLY WOULD THE STATE BE ELIGIBLE FOR DOUBLE THE WINDFALL OF FEDERAL CHILD SUPPORT COLLECTION MONEY, THEY WOULD ALSO BE COLLECTING AND KEEPING THE CHILD SUPPORT PAID BY BOTH THE MOTHERS AND THE FATHERS! The kangaroo court hearings that were held in the early days of the kidnapping debacle were already ordering the mothers into classes to prepare them to enter the workforce. No more protection from worldly moral pollution with home schooling and the nurture and guidance of a stay-at-home mother, as the FLDS religious beliefs direct for those Children Of The Covenant! Those children and their parents were being socially re-engineered into the states latest "family" configuration experiment: the "parentless family!" That's a "family" where the state cares for the children in camps or ranches and the parents run like slaves on a work treadmill of 2 and 3 jobs in order to pay child support. EACH OF THOSE FAMILIES HAD MANY CHILDREN! IMAGINE HOW MUCH THE CHILD SUPPORT COLLECTION WOULD HAVE BEEN, AND THE WINDFALL OF FEDERAL DOLLARS WHICH INCREASES IN DIRECT PROPORTION TO THE AMOUNT OF CHILD SUPPORT COLLECTED! IT WAS THE PERFECT RACKET, EXCEPT IT WAS ILLEGAL! Let's hope that Judge Walther spends many years on her new "bench" in a Federal prison cell for violating the Constitutional rights of those families: with consecutive sentences, not concurrent, for every count for each child illegally kidnapped and falsly imprisoned. The same should apply to members of her Gestapo-Child Protective Services, and to the person who made the original hoax phone call that set the whole disaster in motion! WHEN THE POWER ENTRUSTED TO THE CARE OF PUBLIC SERVANTS IS ABUSED (ESPECIALLY FOR PERSONAL OR INSTITUTIONAL PROFIT) IT IS CALLED CORRUPTION, and must be rooted out with the sternest possible measures! JUDGE WALTHER AND ALL THOSE INVOLVED IN THAT JUDICIAL KIDNAPPING FOR STATE PROFIT SCAM SHOULD BE PROSECUTED, CONVICTED AND INCARCERATED WITH THE MOST SEVERE SENTENCES ALLOWED UNDER THE LAW! Further, because they failed to do what the public entrusted them to do - meet out justice and protect children from abuse - they should be required to return all of the monies earned in salaries and benefits during the entire time they were involved with every judicial kidnapping which stripped parents and children of their Constitutionally guaranteed right to the nurture and companionship of each other, in the state's corrupt pursuit of a huge share of the $4.2 billion, Federal dollars earmarked annually for child support collectors. Those monies, INCLUDING FORFEITED PENSIONS, should be placed in a trust fund to make restitution to all families who have been injured by this corrupt racketeering! THESE STERN MEASURES SHOULD BE APPLIED IN EACH AND EVERY STATE THAT HAS PARTICIPATED IN THIS JUDICIAL KIDNAPPING FOR STATE PROFIT OVER THE LAST 15 YEARS. THE NATION'S ATTORNEY GENERAL SHOULD INITIATE THE INVESTIGATION OF ALL THE CORRUPT FAMILY COURTS IN AMERICA and root out this heinous evil with convictions and draconian punishments of all who have profited by this racketeering. STATE AND LOCAL ATTORNEY GENERALS SHOULD DO THE SAME. Further, CONGRESS SHOULD IMMEDIATELY CUT OFF THIS $4.2 BILLION WHICH IS ENCOURAGING AND ENABLING CORRUPTION IN OUR FAMILY COURTS! THE PRESIDENT OF THE UNITED STATES, AS WELLAS ALL STATE GOVERNORS SHOULD ISSUE EXECUTIVE ORDERS immediately banning the further stripping of physical custody from any parent in Family Court proceedings. When divorce occurs, physical custody should be shared equally by both parents. Further, GOVERNORS SHOULD ORDER ALL OPERATING FUNDS OF FAMILY COURTS WITHHELD, until judges sign a court order quashing all previous orders which stripped physical custody from parents when there was no conviction for a crime against the parent established by due process in a court of law. They should also ORDER OPERATING FUNDS WITHHELD FROM THE STATE LEGISLATURES until they pass laws that strictly forbid the stripping of the physical custody of a child from parents, as well as guaranteeing that State laws will never again interfere with the parent-child relationship! THIS JUDICIAL KIDNAPPING FOR STATE PROFIT HAS SERIOUSLY INJURED THE MENTAL HEALTH OF 40% OF OUR RISING GENERATION. Our nation is already seeing the reaping of this forced separation from natural parents in the increase of mental illness, delinquency, drug and alcohol abuse, suicides, and promiscuous and criminal behaviors in children, grown to adults, over the past 15 years, who have been victimized by this injustice. These children seethe with anger over this forced separation, and they vent that anger in appalling ways; such as the tragic young man who murdered over 30 of his classmates and teachers at Virginia Tech; in outrage for the agony he suffered when he was forcibly removed from his own natural father in divorce proceedings and forced to live with a stepfather whom he hated! American children deserve better. America deserves better. But only aggressive action on the part of its citizens will arrest this cancer of greed and corruption that is consuming our nation! CITIZENS SHOULD MAIL COPIES OF THIS LETTER TO ALL OF THEIR ELECTED OFFICIALS and put them on sternest notice that if they do not immediately do everything in the their power to eradicate this evil that is destroying our nation (including all of the above recommendations), they will be promptly removed from office! Removal from office can be accomplished at the ballot box either removing legislators individually, or by referendum for a Constitutional amendment limiting tenns to eliminate legislators who have grown too comfortable and powerful in their long legislative "careers" handing out the money unconstitutionally plundered from the citizens whom they were elected to represent. OUR NEWSPAPERS HAVE AN OBLIGATION TO PRINT THE TRUTH ABOUT THIS HIDDEN AGENDA OF GREED which is corrupting our courts and causing untold misery, grief and dysfunction in over 40% of our population. THIS LETTER (IN ITS ENTIRETY) SHOULD BE PRINTED IN EVERY NEWSPAPER IN THE NATION! CITIZENS SHOULD ARM THEMSELVES WITH THE FACTS ABOUT THE STEALTH DECLINE OF FREEDOM in our family courts as chronicled by Dr. Stephen Baskerville's scholarly, exhaustive and wholly truthful book Taken Into Custody: The War Against Fathers, Marriage, and the Family. Phyllis Schlafty J.D.'s book The Supremacists: The Tyranny of Judges and How to Stop It details how, in many areas of citizen life some members of the Judiciary in our country have usurped the rights and prerogatives of citizens, such as the prerogative to determine the best interest of children which has traditionally been reserved for thousands of years to parents, and which has been usurped by fiat by judges, in their unbridled grab for unlimited power and wealth. It was Dr. Schlafty's research as head of The Eagle Forum (a government watch dog organization) that "blew the whistle" on the process by which judges and states "manufactured deadbeat dads" (from loving fathers who supported their children well) in order to access the windfall of Federal child support collection money. RIPPING CHILDREN AWAY FROM THE CARE, NURTURE AND COMPANIONSHIP OF THEIR NATURAL PARENTS IS NOT ONLY A VIOLATION OF THE CONSTITUTIONAL RIGHTS OF AMERICAN PARENTS AND CHILDREN, BUT IT IS ALSO A HORRIFIC VIOLATION OF BASIC HUMAN RIGHTS AS DEFINED BY THE GENEVA CONVENTION; THAT IT IS BEING DONE IN AMERICA IN ORDER TO FILL STATE COFFERS WITH A WINDFALL OF FEDERAL MONEY, IS HEINOUSLY EVIL! In the FLDS child kidnapping for State profit debacle, the whole world witnessed that cancerous evil burst forth in a vicious, overt assault on children, mothers, fathers, and a religious community; consuming the integrity of our government institutions and the Constitutional liberties and religious prerogatives of innocent families. IF THAT CANCER IS NOT IMMEDIATELY AND TOTALLY ERADICATED, THE NEXT VICTIMS COULD BE YOU, YOUR FAMILY, YOUR RELIGIOUS PREROGATIVES, AND YOUR FINANCIAL ASSETS! Edmund Burke once wrote that "all that is necessary for the triumph of evil is for good men to do nothing." NOW THAT YOU KNOW THE HIDDEN AGENDA BEHIND ALL CUSTODY CASES IS THE KIDNAPPING OF CHILDREN FOR STATE PROFIT, WHAT DO YOU PLAN TO DO ABOUT IT?
